The Bankruptcy Code was enacted in 1978 as a result of the 1970 Commission on Bankruptcy. The Commission observed that there was no uniformity of exemptions as well as other issues on property. Section 522 is a result of this observation made by the Commission. Bankruptcy Code Section 522 deals with properties exempt from bankruptcy. It permits the debtor to protect certain exemptions and to supplement a discharge and fresh start by avoidance of certain liens on otherwise exempt property. The stated goal of federal bankruptcy law is to provide the honest debtor with a fresh start. According to the U.S. Supreme Court {Chicago, B&Q. RR Co v. Hall, 229 US 511 (1913)}, the Bankruptcy Code is not merely to secure equity among creditors but also to discharge the liabilities of the debtor and to enable him to start afresh with the exempt property. When a debtor files for bankruptcy, all assets of the debtor except the exempt properties become the property of the bankruptcy estate. The Bankruptcy Code defines “property” very broadly as all legal and equitable interests of the debtor and any property that is community property of the debtor and his spouse. Even the property that the debtor selects as exempt property is property of the estate until the exemption claims are confirmed. The exempt properties are necessary for the debtor’s fresh start. The exemption claims are confirmed before the creditors are allowed to participate in the distribution of the property of the estate. The debtor has no control over the property of the estate.
